Thailand published the Cosmetics Act (No. 2) B.E. 2565 (2022), amending the provisions pertaining to some administrative procedures, fees, etc. under the existing Cosmetic Act B.E. 2558 (2015).

The Cosmetics Act B.E. 2558 (2015) is the current overarching cosmetic regulation in Thailand, with 9 Sections and 94 Articles. It stipulates the requirements for the application, renewal, change, and revocation of cosmetic notification, as well as the requirements for cosmetic labeling, advertising, administrative penalties, etc.

On October 12, 2022, Thailand published the Cosmetics Act (No. 2) B.E. 2565 (2022) in the Government Gazette (Vol. 139, Chapter 63) to amend the existing Cosmetic Act B.E. 2558 (2015). The 2022 Act took effect from the date of publication. ¹

Main amendments include:

• The definition of "Cosmetics Review Procedure" is added to Article 4 "Terms and Definitions”.
• Two provisions related to the rules, procedures, conditions, and administrative fees related to submitting applications and issuing certification for cosmetics have been added under Item 12 of Article 6 "Duties of Competent Authorities”.
• The contents of the original Article 21 are revised, with some new provisions being added. The new Article 21 refines the requirements for officials, organizations, institutions, etc. responsible for the review of cosmetics, as well as the rules, procedures, conditions, and administrative fees in the review process of cosmetics.

The Cosmetics Act (No. 2) B.E. 2565 (2022) is an amendment to the Cosmetic Act B.E. 2558 (2015), which only includes revised Articles. The remaining unrevised Provisions and Articles of the Cosmetic Act B.E. 2558 (2015) still apply.

In addition, this revision mainly focuses on the updates of some administrative procedures, fees, and the responsibilities of the competent authority, which may not have significant impact on cosmetic enterprises.
