Prohibiting the sale of cosmetic products containing certain added chemicals—Department's duties.

(1) Except as provided in subsection (3) of this section, beginning January 1, 2025, no person may manufacture, knowingly sell, offer for sale, distribute for sale, or distribute for use in this state any cosmetic product that contains any of the following intentionally added chemicals or chemical classes:

(a) Ortho-phthalates;

(b) Perfluoroalkyl and polyfluoroalkyl substances;

(c) Formaldehyde (CAS 50-00-0) and chemicals determined by the department to release formaldehyde;

(d) Methylene glycol (CAS 463-57-0);

(e) Mercury and mercury compounds (CAS 7439-97-6);

(f) Triclosan (CAS 3380-34-5);

(g) m-phenylenediamine and its salts (CAS 108-45-2); and

(h) o-phenylenediamine and its salts (CAS 95-54-5).

(2) Except as provided in subsection (3) of this section, beginning January 1, 2025, no person may manufacture, knowingly sell, offer for sale, distribute for sale, or distribute for use in this state any cosmetic product that contains intentionally added lead or lead compounds (CAS 7439-92-1), lead or lead compounds at one part per million (ppm) or above, or as otherwise determined by the department through rule making.

(3) An in-state retailer in possession of cosmetic products on the date that restrictions on the sale of the products takes effect under this section may exhaust its existing stock through sales to the public until January 1, 2026.

(1) 이 조항의 (3)항에 명시된 경우를 제외하고, 2025년 1월 1일부터 이 주에서 다음과 같은 의도적으로 첨가된 화학물질 또는 화학물질 군을 포함하는 화장품을 제조하거나, 고의적으로 판매, 판매를 위한 제공, 배포 또는 사용을 위한 배포를 할 수 없다: 

(a) 오르토프탈레이트; 

(b) 과불화알킬 및 폴리불화알킬 물질; 

(c) 포름알데히드(CAS 50-00-0) 및 포름알데히드를 방출하는 것으로 판명된 화학물질; 

(d) 메틸렌 글리콜(CAS 463-57-0); 

(e) 수은 및 수은 화합물(CAS 7439-97-6); 

(f) 트리클로산(CAS 3380-34-5); 

(g) m-페닐렌디아민 및 그 염(CAS 108-45-2); 

(h) o-페닐렌디아민 및 그 염(CAS 95-54-5). 

(2) 이 조항의 (3)항에 명시된 경우를 제외하고, 2025년 1월 1일부터 이 주에서 의도적으로 첨가된 납 또는 납 화합물(CAS 7439-92-1), 납 또는 납 화합물이 백만분의 1 ppm 이상 포함된 화장품, 또는 해당 부서에서 규정 제정을 통해 결정한 화장품을 제조하거나, 고의적으로 판매, 판매를 위한 제공, 배포 또는 사용을 위한 배포를 할 수 없다. 

(3) 이 주 내 소매업자가 이 조항에 따른 판매 제한이 발효되는 날에 소지하고 있는 화장품 제품에 대해서는 2026년 1월 1일까지 대중에게 판매를 통해 기존 재고를 소진할 수 있다. 

(4) 2024년 6월 1일까지 해당 부서는 보건부와 협의하여 화장품에 사용되는 화학물질이나 화학물질 군의 동일하거나 유사한 기능을 제공할 수 있으며, 취약 계층에 영향을 미칠 수 있는 화학물질 또는 화학물질 군의 위험성을 평가하고 식별해야 한다. 부서는 이러한 정보를 공개적으로 제공해야 한다.

 

위와 같이 워싱턴州는 납이 1 ppm 이상 포함되었을 시 2025년 1월 1일부터 판매 불가하며 포름알데히드 등 기타 금지 성분은 2026년 1월 1일부터 판매 불가합니다.
